Biography

Andrew Levine is a partner with BraunHagey & Borden. As a trial lawyer and business advisor, he helps clients navigate a wide array of disputes and business challenges. Andrew has successfully litigated in federal and state courts and arbitrations across the country concerning a diverse array of disputes, including matters involving cryptocurrency funds, investments, and valuations, financial services, corporate governance, intellectual property, antitrust, employee and professional mobility, trade secret misappropriation, breach of contract and fiduciary duties, as well as other complex business disputes and class actions.

Andrew has defended and prosecuted claims on behalf Fortune 500 companies, investment managers, financial services firms, small businesses, start-ups, and individuals.

Representative Matters

  • Andrew secured a defense verdict as lead trial counsel for Sonoma County based Seismic Brewing Company in three-week jury trial in San Francisco Superior Court. Seismic’s former distributor sought a million-dollar termination payment. The jury denied recovery.

  • Andrew secured a complete trial victory in five-week arbitration on behalf of Polychain Capital against a former investor’s claims regarding corporate governance and tax treatment of various cryptocurrency investments. The arbitrator granted Polychain’s claims, including a permanent injunction barring investor from misusing Polychain’s confidential information, denied all of the investor's claims, and awarded Polychain its full attorney’s fees and costs. The decision was later confirmed as a California Superior Court judgment.

  • As lead trial counsel, Andrew represented creditor Polychain Capital in two bankruptcy trials to preserve its claims against a former investor. In a matter of first impression concerning cryptocurrency valuation, he scuttled creditor’s attempt to keep millions of dollars in cryptocurrency assets from creditors. After debtor’s fourth attempted plan was defeated, Andrew negotiated a plan to appoint a trustee to oversee those assets through exit or liquidation.

  • Andrew represented Pepperidge Farm in litigation against an independent distributor in a fraud and breach of contract dispute with implications for Pepperidge Farm’s relationship with thousands of other distributors. The dispute was confidentially settled.

  • Andrew secured a preliminary injunction on behalf of San Francisco based FAZE Apparel against leading gaming organization FaZe Clan. The federal court enjoined FaZe Clan from advertising, promoting, or selling apparel and accessories with the word “FAZE” without also prominently featuring the word “Clan.”

  • Andrew routinely advises financial professionals and executives to navigate exits from their current employer while keeping deferred compensation and avoiding contractual non-compete and non-solicit restrictions. He has advised clients leaving large banks, venture firms and start-ups to start billion-dollar private wealth management and venture firms of their own. He similarly advises financial firms, start-ups and companies to protect their businesses, trade secrets and confidential information when a key employee or executive leaves or is terminated.

Personal

Andrew lives in the San Francisco Bay Area with his wife and two daughters. He enjoys spending his time among the wilds of Marin County and creating lavish meals and messes with his children.
